Abeokuta - The Ogun State election petition tribunal sitting lead by Hon. Justice Y. Halilu, Hon. Justice C. C Okaa and Hon. Kadi M.L Omar has given Labour Party fair hearing after the respondent to All Progressive Congress, Habeeb Wale Ajayi prayed before the tribunal for setting aside of labour party application to inspect electoral materials.
The tribunal also said EPT/OG/Gov/02/2019 and EPT/OG/Gov/03/2019 its extremely important to take a critical look into by the members of the tribunal to steadfast the court hearing as the court is bound by period of time.
President of the tribunal sitting, Justice Halilu said there won't be any entertainment of delay from the petitioners and respondents.
He asked the respondents to focus on the court of Appeal in respect to EPT/OG/Gov/02/2019 and EPT/OG/Gov/03/2019 as he expected the matters to be resolved through consolidation means.
The petitioner of EPT/OG/Gov/03/2019, Chief Modupe Sanyaolu was represented by Comrade Abayomi Arabambi while they were stand-in by Hassan Balogun, M.O Mawah, S.K Osaigbova and H.O Adudu.
The second respondent was represented by Hon. Habeeb Ajayi and E.B Adelabu, Yetunde Odunsote, A. O Abayomi
Habeeb Ajayi prayed before the tribunal for indulgence to grant the hearing of the applicantions, also ask for order of the tribunal consolidating without granting the applicant fair hearing.
He also prayed before the tribunal to set aside the application filled on 9th of April 2019 by applicants based on lack of merits
According to him:
" I urge the honorable tribunal to set aside the application seeking petitioners to inspect electoral material in the election they didn't participated, They never participated, why are they now interested in inspections election materials they didn't participated, said Habeeb Ajayi."
He said the petition is contradicting the Electoral Act of Nigeria.
In response to Habeeb's prayer, O. H Balogun said a 14 pages counter affidavit was filled in respect to the motion filled by Hon. Habeeb Ajayi but he denied up till when the tribunal members produced him with the copy of the received counter petition served to his team with date.
After so many reaction and arguments by the legal counsels, the members of the election petition tribunal adjourned the hearing to 25th of May 2019.
